7. AI Feedback Disclaimer

GOATY and related features use artificial intelligence, computer vision, pose estimation, automated scoring, voice systems, and software-based analysis. The Service may misread video, body landmarks, swing phases, movement patterns, physical limitations, injury history, handedness, environment, equipment, intent, or context. Outputs may be inaccurate, incomplete, outdated, delayed, unsafe for your individual situation, or different from advice a qualified professional would give. You are solely responsible for deciding whether and how to use any cue, drill, recommendation, analysis, score, voice instruction, chat response, or other output.

The Service is provided for informational, educational, entertainment, training, and general performance purposes only. It is not medical advice, physical therapy, diagnosis, treatment, rehabilitation, legal advice, or a substitute for a physician, physical therapist, qualified golf professional, or other licensed professional. Never disregard professional medical advice or delay seeking it because of anything provided by the Service.

8. Physical Activity, Injury Risk, and Assumption of Risk

Golf practice, golf swings, drills, exercise, physical movement, swing changes, training aids, clubs, balls, indoor practice, outdoor practice, live lessons, and following coaching suggestions involve inherent and unpredictable risks. These risks include pain, strain, sprains, falls, collisions, overuse injuries, back injuries, neck injuries, shoulder injuries, elbow injuries, wrist injuries, hip injuries, knee injuries, aggravation of existing conditions, death, and property damage.

You understand and agree that not every product, service, drill, cue, swing change, movement, or recommendation is suitable for every person. Your age, health, fitness, flexibility, strength, prior injuries, surgeries, disabilities, environment, equipment, and skill level may make some activities unsafe for you. You are solely responsible for evaluating your condition, warming up, practicing safely, maintaining adequate space, using appropriate equipment, stopping when something feels wrong, and consulting a qualified professional before using the Service or following any recommendation.

Stop immediately if you experience pain, dizziness, numbness, weakness, shortness of breath, discomfort, or any unusual symptom. Consult a physician, physical therapist, or other qualified professional before continuing.

To the fullest extent permitted by law, you knowingly, voluntarily, and expressly assume all risks arising from or related to your access to or use of the Service, including risks arising from AI-generated feedback, human instruction, automated analysis, drills, practice, exercise, equipment, your environment, and your own decisions.

9. Release, Waiver of Claims, and Agreement Not to Sue

To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue the Released Parties for any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, or expenses of any kind, whether known or unknown, arising out of or related to:

This waiver includes claims based on negligence to the fullest extent permitted by law. Some jurisdictions do not allow certain waivers, releases, limitations, or exclusions. In those jurisdictions, these Terms apply only to the maximum extent permitted by law.

10. Disclaimer of Warranties

The Service and all content, outputs, products, and features are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of accuracy, completeness, reliability, safety, availability, merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or produce any specific result.

11. Payment and Access

Access to some features may require an account, subscription, purchase, app-store transaction, or recurring payment. If payment is required, you agree to the pricing, billing, renewal, cancellation, and refund terms shown at the time of purchase or provided by the applicable app store or payment processor. We may change plans, features, pricing, availability, or access rules prospectively.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, misuse the Service, create risk, fail to pay, or otherwise use the Service in a way we determine is harmful. After termination, we may retain data as described in our Privacy Policy, including anonymized or aggregated data for training, analytics, research, and business purposes.

13. Limitation of Liability

To the maximum extent permitted by law, the Released Parties shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages; personal injury; death; property damage; lost profits; lost revenue; lost data; loss of goodwill; substitute services; or damages arising from reliance on the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims under any theory of liability, whether in contract, tort, negligence, strict liability, statute, or otherwise, shall not exceed the greater of: (a) the amount you paid us for access to the Service in the 12 months before the event giving rise to the claim; or (b) $100.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or related to your use of the Service, your User Content, your violation of these Terms, your violation of law, your unsafe conduct, or your violation of any third-party rights.

15. Governing Law, Arbitration, Class Action Waiver, and Jury Trial Waiver

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles. To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, any purchase, or any relationship with us shall be resolved by confidential binding arbitration in Colorado, except that we may seek injunctive or equitable relief in court for intellectual-property, security, fraud, or unauthorized-access matters.

To the fullest extent permitted by law, you and we agree that disputes must be brought only on an individual basis. You waive any right to participate in a class action, class arbitration, collective action, private attorney general action, or consolidated proceeding. You and we also waive any right to a jury trial to the fullest extent permitted by law.

16. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website or otherwise made available through the Service. Continued access to or use of the Service after an update constitutes acceptance of the updated Terms.
